Cancellation Policy

TERMS AND CONDITIONS OF CHARTER By booking a charter, you agree to the following: CANCELLATION AND REFUND POLICY All reservations must be canceled 48 hours prior to your charter departure date to be eligible for a refund. If you call after the 48-hour time frame or do not show up you will be charged the full Amount. BAD WEATHER POLICY 3:16 Kayak Adventures, LLC charters will run if there is light rain or other moderate weather conditions. In the rare event that 3:16 Kayak Adventures, LLC is forced to cancel your trip due to weather, you will have the opportunity to reschedule your activity or receive a full refund. 3:16 Kayak Adventures, LLC reserves the right to cancel charters if weather conditions are not conducive to a safe and enjoyable experience. DISCLAIMER ABOUT CHARTERS 3:16 Kayak Adventures, LLC will make every effort to assure an enjoyable charter. Fish are wild animals in their natural habitat and are not in tanks or netted areas. Catching a fish is NOT A GUARANTEE; it depends on the several conditions that are beyond the control of your Captain. If you do catch a fish, there is no guarantee that you can keep it. 3:16 Kayak Adventures, LLC is bound by federal law in addition to the laws of the State of Florida which limit what can be retained. The decision of your Captain in this regard is final. It is highly recommended that you dress weather appropriately, bring plenty of water and wear polarized sunglasses during the charter excursion. ACKNOWLEDGMENT OF RISK, WAIVER OF LIABILITY, INDEMNIFICATION, AND CONSENT The undersigned acknowledges and consents to the following, in consideration for the participation in activities provided by 3:16 Kayak Adventures, LLC, including, but not limited to, charter boat fishing excursions and all related activities. I acknowledge the following risks associated with charter boat and fishing activities, including, but not limited to, boarding and disembarking vessels, natural hazards, such as weather conditions, temperature, sun, rain, lightning storms, presence of hooks, knives, gaffs, and other tools used while fishing within ACKNOWLEDGMENT OF RISK / WAIVER OF LIABILITY I acknowledge the aforementioned risks, among others, of death, disability, personal injury, property damage, loss of property, or actions of any kind, which may result from the participation in the anticipated activities during the fishing excursion with 3:16 Kayak Adventures, LLC, and which are not eliminated even if 3:16 Kayak
